Chapter 26 ZONING*
Article II. Use Districts.
26-75 Senior Citizen Housing Development--S-C.
The provisions of Sections 26-42 through 26-54 of this
chapter are made applicable to all S-C districts subject to the specific
provisions of this section.
A. Intent. To promote and encourage development of multiple
unit housing for senior citizens in locations offering easy access to needed
services, shopping, and recreational facilities; and which would be consistent
with the best interests of the city of Oroville.
B. S-C is an Overlay Zone. The planning commission, after
considering the needs of senior citizens, shall adopt as an overlay zone areas
within the city ideally suited for development of senior citizen housing. This
zone will not change or alter the current zoning, but will only indicate where
senior citizen housing development will be considered upon proper
application.
C. Establishment of S-C District. The S-C district may be
combined with any residential or commercial zoning district within the boundary
of the overlay zone to be adopted by the planning commission. This district is a
combining district with respect to the uses allowed and permits those uses
allowed by the districts with which it is combined, i.e. SC/C-1, SC/R-3, etc.,
and such notations shall be utilized on the zoning application, agenda, notices,
codes, and zoning map.
D. Development Standards in S-C District.
1. Lot Area, Frontage, and Setback Requirements. The minimum
lot size, lot frontage, and setback requirements applicable to any zone combined
with S-C district shall apply, provided the planning commission may grant a
modification after considering the general objectives of a senior citizen
housing development and finds that a practical result will be
obtained.
2. Residential Densities. The residential density allowed in
the S-C district shall be limited to the following formula:*
Studio Apartment - seven hundred fifty square feet of land
area
One Bedroom Unit - nine hundred square feet of land
area
Two Bedroom Unit - one thousand fifty square feet of land
area
* Note: maximum density will be determined by
the General Plan Diagram Land Use designation of the property to which the S-C
zone is applied.
In calculating the number of units permitted for each type or
combination of units, the gross land area excluding street dedications shall be
used.
3. Building Height Limits. The height of buildings or
structures shall be limited to the height requirements of each particular zone
combined with the S-C district.
E. Parking. For the S-C district, see Section
26-49.
F. Fences/Hedges. The fence and hedge requirements of each
particular zone combined with the S-C district shall apply.
G. Signs. The sign provisions of each particular zone
combined with the S-C district shall apply.
H. Application for S-C District.
1. Proposed Development Plan. An application for rezoning to
a S-C district shall require a proposed development plan which shall include
maps, designs, and such other materials and data necessary to show:
a. Plot plan indicating streets, private drives, and
rights-of-way.
b. General topography of the site, location of proposed
housing units, location of all entrances, vehicular and pedestrian circulation,
parking spaces and open spaces.
c. Architectural renderings to demonstrate the concept and
character of the proposed development including floor plans for each type of
unit.
d. Vicinity Map showing the location of shopping, medical,
recreational, government, and other services required by senior
citizens.
e. Proposed method of financing, i.e. market rate or
subsidized rents, percentage of each, federal and state financing program to be
used.
f. Management plan to ensure occupancy by senior citizens
only, and maintenance plan to assure long-term upkeep.
2. If a chapter is adopted amending the zoning map to create
an S-C District, the proposed development plan shall become a part of the
ordinance rezoning the area to an S-C District. This shall be binding on the
developer and subsequent owners as regulations for land use within the
area.
I. Site Plan and Development Review. All new construction in
an S-C district, except for single family and two-family dwelling units, shall
be subject to review and approval by the development review board. (Ord. No.
