Chapter 26 ZONING*
Article II. Use Districts.
26-56 Hillside Residential--H-R.
The provisions of Sections 26-42 through 26-55 of this
chapter are made applicable to all H-R districts subject to the specific
provisions of this section.
A. Intent. To provide for an orderly, harmonious development
of the foothills with a minimum amount of disturbance of natural terrain by
relating residential density to natural topography, and to encourage and provide
incentives for excellence of design and engineering techniques. Limitations are
imposed upon development and disturbance of natural terrain in order to minimize
grading, erosion, runoff, fire hazards, geologic hazards, removal of
vegetation,
and to help ensure utilization of land in balance with its
natural capabilities to support development.
B. Use Regulations. In the H-R district, no building or land
shall be used and no building shall be erected or structurally altered unless
otherwise provided herein, except for one or more of the following
uses:
C. Uses Permitted in H-R District.
1. Single family dwellings including private garages and
other accessory buildings and uses normally incidental and subordinate to single
family residences.
2. Public schools, parks, and/or playgrounds compatible with
the general plan.
3. Residential facilities, and small family day care homes,
and large family day care homes, as defined in the California Community Care
Facilities Act, the California Child Day Care Act, and this chapter.
4. Home occupations in accordance with Section
26-46.
5. A single-family manufactured home (including a mobilehome)
that was manufactured no more than ten years prior to the date of the
application for the issuance of a permit to install the manufactured home (in
accordance with Government Code §65852.3(a)), provided it is placed on a
permanent foundation and siding is extended to the foundation in a manner that
is consistent with conventional homes.
D. Conditional Uses Requiring a Use Permit in H-R
District.
1. Churches, public buildings, and public utility buildings
and substations.
2. Educational institutions.
3. Cemeteries, crematoriums, and mausoleums.
E. Development standards in an H-R District.
1. Lot Area. In an H-R district, each lot shall have a
minimum area of two acres.
2. Lot Width. In an H-R district, each lot shall have a
minimum width of one hundred fifty feet except that the development review board
shall have the authority to approve less width where unique natural features or
conditions exist to make such a requirement unreasonable within the overall
intent of the H-R district, and where the other provisions of this section are
met.
3. Height Regulations. In an H-R district:
a. The maximum height of any main building or structure shall
not exceed thirty feet.
b. Accessory buildings shall not exceed fifteen feet in
height.
4. Yards. In an H-R district:
a. Front Yard. In an H-R district, minimum required setback
is thirty feet, except as may be shown otherwise in officially adopted Master
Street and Highway Plan or other city code.
b. Side Yard. In an H-R district, minimum of twenty feet
deep.
c. Rear Yard. In an H-R district, minimum of twenty-five feet
deep.
5. Irregular Lot Configurations. In an H-R district, lots
with irregular configurations such as segments of a circle, panhandle shaped, or
polygon shall have a front yard at least equal in area to that required for
conventional shaped lots. The front yard shall be measured either parallel or
perpendicular to narrow access corridors.
6. Grading. In an H-R district, grading shall be permitted
upon securing approval of the site plan by the development review board.
Approval shall be granted upon the finding that the purpose for which the
grading is proposed is essential for the establishment or maintenance of a use
which is expressly permitted herein and that the design, scope, and location of
the grading proposed will be compatible with adjacent areas and will result in
the least disturbance of terrain and natural land features.
7. Trees. In an H-R district, all trees which have a six inch
or greater diameter trunk size at a point three feet above grade shall not be
removed except as approved by the development review board. The location of all
such trees shall be shown on plans submitted for site plan and development
review.
F. Parking. In an H-R district, the general provisions of
Section 26-49 shall apply.
G. Fences/Hedges. In an H-R district, the general provisions
of Section 26-48 shall apply.
H. Signs. In an H-R district, the general provi-sions of
Section 26-200 shall apply.
I. Livestock/Agriculture. In an H-R district, the general
provisions of Section 26-54 shall apply.
J. Accessory Buildings. In an H-R district, the general
provisions of Section 26-45 shall apply.
K. Site Plan and Development Review. All new construction in
an H-R District, except for single and two-family dwelling units, shall be
subject to review and approval by the development review board. (Ord. No. 1167
