26-46 Home occupations.

A. Permit Required. No home occupation shall be established unless a use permit has been issued by the planning department in accordance with the provisions of this section.
B. Occupations. The home occupation permit may be issued by the planning department when the applicant can show that all of the criteria set forth in this section can be met.
C. Criteria. All home occupations shall be subject to the following criteria:
1. The home occupations use shall be confined principally to one room located within the dwelling or accessory building.
2. There shall be no use of material or mechanical equipment not recognized as being part of normal household or hobby use.
3. The use shall not generate pedestrian or vehicular traffic beyond normal to the district in which it is located.
4. There shall be no excessive or unsightly storage of materials and/or supplies, indoors or outdoors.
5. It shall not involve the use of signs or structures other than those permitted in the district in which it is a part.
6. Employment shall be confined to the residents of the dwelling unit, and shall not exceed two persons engaged therein.
7. No more than one home occupation permit shall be granted per dwelling unit.
8. No more than one truck of no larger size than 3/4 ton shall be based at the home in conjunction with any home occupation.
9. There shall be no addition, alteration, or remodeling permitted in connection with any home occupation.
10. No home occupation shall be permitted which creates noise, odor, dust, vibration, fumes, or smoke readily discernible at the exterior boundaries of the parcel on which it is located.
11. Home occupations shall comply with all federal, state, county, and local regulations, statutes, and provisions.
12. No home occupation shall be permitted which will create any electrical disturbance adversely affecting the operation of any equipment located in any other dwelling unit or on property not owned by the home occupation permitted.
13. No home occupation shall require elimination of required off-street parking spaces.
14. Renters require prior written approval of the property owner before a home occupation permit is processed.
15. The making of merchandise for sale is permitted provided that the storage of such merchandise does not exceed the total allowable area for home occupations and does not require the transporting of materials or finished products by means other than an automobile, standard size van, or truck larger than 3/4 ton.
16. Delivery of materials to the subject residence shall not exceed more than two deliveries per month. No delivery shall be by means other than an automobile, standard size van, or truck larger than 3/4 ton.
17. The city of Oroville may, at all reasonable times during normal working hours, enter the premises for the purpose of inspection to determine whether or not the conditions of the use permit are being met.
D. Validity. A home occupation shall be valid only as to the occupation and residence for which it is issued. Said permit shall be valid:
1. Until revoked;
2. For a predetermined period; or
3. When the occupation for which the permit is granted is discontinued for one year.
E. Abatement.
1. Following written notification to the permittee, the planning department may revoke a home occupation permit upon determination that the occupation has been conducted so as to create a nuisance, or other undesirable condition interfering with the public health, safety, or general welfare or is in violation of the provisions or conditions of this chapter.
2. Any person may initiate proceedings for revocation of a home occupation permit by filing a statement with the Planning Department which sets forth the grounds upon which he believes the permit should be revoked.
3. Factual determinations made by planning department staff in support of a decision to issue or withhold a home occupation permit may be appealed to the planning commission. (Ord. No. 1167 (part): Ord. No. 1532A § 2: Ord. No. 1649 § 1.)
