23-137 Criteria.

The director of public works shall approve a completed application for a boundary line modification made in accordance with the requirements of this article IX and the following criteria:
(1) The resulting parcel or parcels of land shall conform to the provisions of the applicable zoning and building ordinances of the city of Oroville; provided, however, that the director of public works may approve boundary line modifications of nonconforming lots where the modifications do not adversely affect the public health, welfare and safety.
(2) No additional lot or parcel of land shall be created by the boundary line modification.
(3) The applicant shall provide:
(A) Proof to the director of public works that taxes have been paid;
(B) A deed or deeds reflecting the approved boundary line modification, executed by all parties in suitable form for recording, together with applicable recording fees and documentary transfer taxes, if any;
(C) A deed or deeds reflecting the approved boundary line modification shall bear the following notation:
“The purpose of this deed is to effect a boundary line modification as approved by the Oroville Director of Public Works on (date). The above described lands are to become a part of those lands described in deed to (name) as filed for record in (book and page/serial number), Assessor’s Parcel Number (__-___-___). No new parcels are hereby created. The scope of review of said boundary line modification was limited as specified in Government Code § 66412(d), and approval of it does not constitute assurance that future applications for building permits or other land use entitlement on the modified lots or parcels will be approved by the City of Oroville.”
